Abstract :Offense of intentional contamination of the environment is an offense type, entered into our legislation with the Turkish Criminal Code number 5237 on 2005 . It has been accommodated with European Union Directives by defining these actions as a crime . Depending on environmental pollution, especially the emergence and consequences of global warming mankind began to be sensitive in this area . In parallel, leaving neater and livable environment for the future concerns has led the legislators to organize such a crime . This is a positive development for our country, our article examined this kind of crime by seperating the crime elements
