Abstract :Basın İş Kanunu'nda işveren kavramı tanımlanmamıştır. Bu durum, Ka­nunun bir boşluğu olarak karşımıza çıkmaktadır. Bu çalışmada, Basın İş Ka­nunu'ndaki boşluğun doldurulması amacıyla Yargıtay kararları ve öğretideki görüşler doğrultusunda işveren kavramı açıklanmaya çalışılmıştır. Kanımızca Basın İş Kanunu'ndaki boşluğun kendisine göre genel bir kanun olan İş Ka­nunu ile doldurulması gerekmektedir. Bu bağlamda İş Kanunu'ndaki işveren tanımından hareketle, Basın İş Kanunu açısından işveren; "Bir hizmet akdine dayanarak Türkiye'de yayınlanan gazete ve mevkute/erle haber ve fotoğraf ajanslarında veya radyo ve televizyon kuruluşlarının haber birimlerinde ve her türlü fikir ve sanat işinde ücret karşılığı gazeteci çalıştıran gerçek veya özel hukuk tüzel kişisi" şeklinde tanımlanabilir. In this study, in accordance with the Turkish Labour Law of Press, it is included the Supreme Court decisions and opinions in doctrine, it has been examined the employer concept. Additionally in this study, it is tried to be explained the employer concept by filling the perceived gap in Labour Law of Press with Labour Law, which is a general law according to our idea. Thus, moving from the definition of employer that is artificial or natural per­son who employs worker" in Labour Law No: 1475, the definition of employ­er from the viewpoint of Labour Law of Press can be like that: "artificial per­son of private law or natural person who employs journalists in newspapers and magazines published in Turkey, in news and photograph agencies ar in news departments of radio or television organizations and in every workings form related to ideas and art in return pays salary to them, on the basis of a contract of service".
