Abstract :In this study, certain issues regarding the institution of suspension of imprisonment sentences regulated under Article 51 of the Turkish Penal Code No. 5237 have been examined, and solution proposals for these issues have been presented. The institution of suspension regulated in Article 51 of the Penal Code was introduced to achieve the rehabilitative purpose of modern criminal law. The institution is frequently approached in this practice, and decisions that are inconsistent with the purpose of the postponement are made during the investigation phase.
