Abstract :İslam hukukunda cezalar, `Had cezaları`, `Kısas ve diyet` cezaları ve `Ta`zir` cezaları şeklinde üçlü tasnife tabi tutulmuştur. Sürgün cezasının, ta`zir veya hadd cezalarından hangisine girdiği hususunda mezhepler arasında ihtilaf edilmiştir. Hanefilere göre sürgün cezası hadd değil, ta`zir cezasıdır. Diğer üç mezhebe göre sürgün , hadd cezasının bir parçasıdır. Ancak Malikilere göre sadece erkeklere uygulanırken, Şafii ve Hanbeli mezhebine göre, uygulamada kadın-erkek ayrımı yoktur.
