Abstract :Current legal regulations are not sufficient to fairly resolve medical malpractice cases in Emergency Departments. Involving healthcare professionals and emergency medicine related specialties more effectively in malpractice cases that occur in Emergency Departments can ensure that decisions are made more accurately and on time. In addition, eliminating the deficiencies in the trial process and creating a more transparent process will ensure that medical malpractice cases are resolved effectively. The increasing number of medical malpractice cases in Emergency Departments is a very complex situation in which the errors and omissions of physicians and other healthcare professionals are examined while performing their profession. The complex structure of healthcare services reveals that alleged errors and negligence must be evaluated not only with individual responsibilities but also with healthcare delivery processes. Keywords : emergency medicine, malpractice, forensic medicine, Professional Responsibility Board
