Abstract :ÖZET Hz. Muhammed’in (sas) Medine’ye hicretinden hemen sonra giristigi faaliyetler arasında devlet kurma faaliyeti vardır. Onu böyle yapmaya götüren birtakım sosyal ve siyasî sebeplerin oldugu muhakkaktır. Fakat asıl hedefi Allah’tan aldıgı teblig görevini geregince yerine getirmektir. O, gerek Mekke gerek Hicret sonrası ilk icraatlarında Medine’de, öncelikle devlet kurmanın geregini fark etmis biri olarak faaliyetlerini buna teksif etmis ve birtakım altyapı hazırlıklarından (nüfus sayımı, kardeslestirme ve mescit insası) sonra Medine’de yasayan gayr-i Müslim unsurlarla birlikte Medine Devleti’ni kurmustur. Hamidullah’ın tespitlerine göre, bu devlet için ortaklasa olusturulan antlasma, dünyanın ilk yazılı anayasasıdır. Bu durum bizi, Resulullah’ın kurdugu devletin anayasal ve konfederatif bir hukuk devleti oldugu kanaatine götürmektedir. Anahtar Kelimeler: Muhammed, Devlet, Anayasa, Medine Devleti, Hicret. ABSTRACT Activities of the Prophet Muhammad on the Foundation of State Among the activities that Prophet Muhammad attempted immediately after the Hegira, there is a foundation of state. Of cours, he had some social and political causes forced him to do this activity. But his main aim fulfiled the the duty of notification which he has took from God perfectly. First of all, he whether his activities in Mecca period or his actions in Madina after the Hegira, as somebody who realized the necessity of founding a state, he concentrated his activities to do this, and after the preparation of the background (the census, fraternization between Muslims and constructing of Masjid ) he founded Madina City State with the Muslim and non Muslim people who lives in Madina. According to Hamidullah, the agreement which has constituted collectively in this period is the first written constitution in the world. This conditions takes us opinions to which the state of God’s Prophete is a juridical state and a confederate state. Key Words: Muhammad, State, Constitution, State of Madina, the Hegira.
