Abstract :İflasa tabi bir tacirin borcunu ödeyemez duruma gelmesi halinde iflas kararı verilebilecektir. Tacir, iflas kararından sonra müflis olacaktır. Buna mukabil bir iflas masası oluşturulur. Alacaklılar da belli sıraya girer ve bu alacaklarını iflas masasından talep ederler. Dolayısıyla bu iflasın hileli hareketler ile gerçekleşmesi durumunda Türk Ceza Kanunu’nca bir yaptırım öngörülmüş ve bu makalede de bu suç ve yaptırım kapsamlıca incelenmiştir.
