Abstract :The Council Framework Decision on “combating certain forms and expressions of racism and xenophobia by means of criminal law” was adopted on 28 November 2008 by the Council of the EU. This decision closely concerns Turkey. While the article examines the content of this decision, the real aim is to analyze the criteria put forth in the decision on how to determine genocide.
