Abstract :Dersaadet Tahvilat Borsası’nın kurulduğu 1866 yılından günümüze gelinceye kadar, sermaye piyasası hukukunun Türk hukuk sisteminde bağımsız bir hukuk dalı olarak yerini aldığından ve Sermaye Piyasası Kurulu’nun da üstlendiği görev ve yetkilerini başarı ile yerine getirmesi sonucunda çok geliştiğinden tereddüt etmemek gerekir. Bugün sermaye piyasası hukuku, sermaye piyasasının kendisi, sermaye piyasasında işlem gören yatırım araçları, sermaye piyasasının aktörleri ve bunlar arasındaki hukuki ilişkiler ile sermaye piyasasında faaliyette bulunma hakkı, faaliyetlerin ve hukuki işlemlerin denetimi konularını içermektedir. Sermaye piyasası hukukunun dahil olduğu hukuk dalının hangisi olduğu sorusunun cevabının ise halen tartışılmakta olduğu görülmektedir.
