Abstract :Nesih konusu, İslamî ilimlerin çok erken dönemlerinden itibaren literatüre yansıyan tartışmalara konu olmuştur. Nesihle ilgili pek çok tartışma noktasından biri de Kur’ân’ın sünneti, sünnetin de Kur’ân’ı neshedip edemeyeceği meselesidir. İmam Şâfiî insert ignore into journalissuearticles values(v. 204/820);, bu ikisinin birbirinin benzeri olmamasından hareketle, Kur’ân ve sünnetin birbirini neshedemeyeceğini söyler. Kur’ân’ın sünneti neshi konusunda Şâfiî’nin görüşü benimsenmemiş, sonra gelen hem Hanefî hem de Şâfiî usûlcüler, Kur’ân’ın sünneti neshini kabul etmişlerdir. Sünnetin Kur’ân’ı neshi konusunda ise Hanefîler yine İmam Şâfiî’ye muhalefet ettikleri hâlde, Şâfiî âlimler farklı tutumlar benimsemişlerdir. Bu çalışmada İmam Şâfiî’den Klâsik Dönem’e kadar belli başlı Hanefî ve Şâfiî usûlcülerin Kur’ân ve sünnetin birbirini neshi konusundaki görüş ve delilleri incelenerek tartışmanın kaynağındaki anlayış farkı tespit edilmeye çalışılmıştır. One of the points that has been discussed is whether a Quranic text can abrogate a sunnah and vice versa. Shafi argues that these two can not abrogate each other since they are not each other’s counterpart. Neither Hanafis nor Shafis after Shafi embraced his views about the abrogation of sunnah by Quran. On the other hand, the abrogation of Quran by sunnah was more controversial. Hanafis agreed that sunnah can abrogate Quran as well. However, some of the Shafi jurists rejected it like Shafi himself; while some other Shafis acknowledged that it is plausible. In this paper, it is aimed to determine the foundation of the dispute, via investigating the perspectives of prominent Hanafis and Shafis from Shafi to the classical period.
