Abstract :Kefaletten dönme, kefalet sözleşmesini sona erdiren nedenlerden biridir. Kefil ancak bazı şartların gerçekleşmesi durumunda kefaletten dönebilir. Bu şartlardan ilki henüz doğmamış bir asıl borçtur. İkinci şart ise borçlunun mali durumuna ilişkindir. Borçlunun mali durumu ya kefaletten sonra bozulmuş olmalı ya da kefil bu hususta yanlış bir değerlendirme içerisinde bulunmuş olmalıdır. Kefilin sözleşmeden dönebilmesinin son şartı ise beyanın yazılı olarak yapılmasıdır.
