Abstract :Hukuk Muhakemeleri Kanunu m. 353’te yer alan “Duruşma yapılmadan verilecek kararlar” başlıklı düzenlemenin 1. fıkrasının a bendi istinaf kanun yolunun yürürlüğe girmesinden sonra çokça başvurulan bir hüküm olmuştur. Söz konusu düzenleme bir kısım problemler ihtiva etmektedir. Bu makalede HMK m. 353/1-a hükmü eleştirel bir şekilde ele alınacak ve ortaya çıkarabileceği problemler konusunda çözüm önerileri sunulacaktır.
