A LEGAL ASSESSMENT OF ISRAEL’S ATTACKS ON GAZA

Abstract :Since 1948, Israel has continued to violate human rights in the occupied Palestinian territories. Especially since 2006, it has been keeping hundreds of thousands of Palestinians living in the Gaza Strip under blockade. In reaction to this situation, on 7 October 2023, Palestinian resistance groups launched military attacks against Israel from the Gaza Strip. In response to this attack, the Israeli armed forces targeted the Gaza Strip and the West Bank. As a result of these attacks of the Israeli forces, 44 thousand people, mostly children and women, have been killed and more than a hundred thousand civilians have been injured. Since the first day, Israel has bombarded cities and towns continuously from the air, land and sea. Gaza in particular has been turned into an uninhabitable place. As a result of these attacks disregarding the rules of international humanitarian law, Israel has committed crimes against humanity, war crimes and genocide. In this study, the crime of genocide, one of the crimes committed by Israel in Gaza, is analysed on the basis of the cases in international criminal courts and the case brought by the Republic of South Africa against Israel in the International Court of Justice.Keywords : Soykırım, Filistin, Gazze, savaş suçları, insanlığa karşı suçlar
