Abstract :Özet Îsâ b. Ebân fıkıh usulü meselelerini Hanefî mezhebine uygun biçimde ele alıp bu konuda eser veren âlimlerin ilklerinden sayılır. Mezhebin kurucusu olan üç alimden biri İmam Muhammed b. Hasan eş-Şeybânî’nin talebelerinden olan İsa b. Eban’ın görüşleri Hanefîlerin fıkıh usulünü oluşturmada önemli ölçüde etkili olmuştur. Bu makalede Hanefî usulünün doğuşuna ışık tutmak amacıyla İsa b. Eban’ın Hanefî usul eserlerindeki görüşlerini takip ederek bir araya getirdik ve zaman içinde kendisinden sonraki Hanefi usulcülerle onun görüşleri arasında meydana çıkan ortak ve farklı noktaları ortaya koymaya çalıştık. Abân is one of the foremost scholars in early period who have spoken of and written on the questions in Islamic jurisprudence according to Hanafi school. Being one of the students of Imam Muhammad b. Hasan al-Shaybani who is one of the three founders of this school, his views had a significant impact on the composition of Hanafi Jurisprudence. In this article I collected his views mentioned in Hanafi jurisprudence books trying to shed light on the early development of Islamic jurisprudence and compared his views with views of later Hanafi Jurisprudence scholars to find the points of agreement and disagreement between them over time.
