Abstract :Öz Bu araştırma Aile Hukuku alanında İslâm Hukukunu uygulamaya çalışan Suudi Arabistan’da bedelli boşanma ve muhâlea ile ilgili resmi işlemleri ve mahkemelerdeki uygulamaları incelemektedir. Konunun İslâm Hukukundaki teorik yönüne de işaret edilmiştir. Araştırmada Suudi Arabistan hukukî mevzuatına, Riyad’daki Sosyal Güvenlik ve Nikâh Mahkemesi ile Riyad Genel Mahkemesindeki gözlem ve incelemelere dayanılmıştır. Teorik bilgilerde ise temel Hanbelî fıkıh kitapları esas alınmıştır. Judicial Applications of Mukhala`a and Divorce in Exchange for Payment a Field Research in Saudi Arabia Abstract This research studies the judicial applications and procedures related to mukhala`a and divorce in exchange for payment in the courts of Saudi Arabia which puts Islamic law in force in the field of Family law. It also points out the theoretical background of the subject in Islamic law. The research depends on the laws and regulations of Saudi Arabia, interviews with the judges, and the author’s observations and investigations in the Social Security and Marriage Court of Riyad and General Court of Riyad. As for the theoretical rules, it depends on the widely used law books of Hanbalite Madhhab.
