Abstract :Kadro karşılığı sözleşmeli personel insert ignore into journalissuearticles values(KKSP); Türkiye’de kamu personel sistemi içinde mevzuatta “tanımlanmayan” bir statüdür. İlk olarak, bütçe kanunlarına konulan hükümle Devlet Planlama Teşkilatı için yapılan bu uygulama daha sonra hızla yayılmıştır. Mevzuatta KKSP’nin memur mu yoksa sözleşmeli personel mi olduğuna ilişkin net bir ayrım yoktur. Bürokrasinin bu en üst düzey ayrıcalıklı kesimi bir memur kadrosu işgal ettiği için memur istihdamına ancak sözleşme imzaladığı için de sözleşmeli personel kapsamına alınabilir. Bu bağlamda yapılan çalışmanın amacı Türkiye’de kamu personel sisteminde giderek yaygınlaşan bu statünün tüm boyutlarıyla ortaya konmasıdır. Bununla birlikte çalışmanın iddiası, bilinenin aksine, KKSP istihdamının sözleşmeliliğin bir türü olmadığı aksine bu statünün ücret yönünden avantajlı ve memurluğa yakın bir statü olduğudur.   A“stabilized” contractual personnel is a form of contractual status that is not clearly “defined” in Turkey’s public personnel system laws. At the beginning this type of personnel category was only created-through the use of a law decision applied on budget laws for The State Planning Organization but then it spread to all other public employment categories quite fastly. The Turkish law does not separate clearly whether “stabilized” contractual personnel is going to be considered as a civil servant or a contractual personnel. This creates a high level privileged class of bureaucracy. Not only this type of personnel can be defined as civil servant position as they belong to civil servant cadre but also they can be defined as contractual personnel because of signing of a contraction. The aim of the study is an attempt to define this hybrid form of personnel status - that is becoming widespread in the Turkey’s public personnel system - taking into account all its dimensions. Moreover it is claimed that “stabilized” contractual personnel is not a form of contractility, on the contrary this position has many additional advantages because of its capacity to combine high salaries with a position which is close to civil servant status.
