Abstract :İslâm, sahih nikahla meşru cinsel ilişki dışındaki her türlü cinsel ilişkiyi –livata dahil- yasaklamış, bu fiilleri suç saymış ve caydırıcı cezalar öngörmüştür. Osmanlı hukukunda da livata suç sayılmış, bu suça Ebu Hanife’nin görüşüne uygun tazir cezaları önerilmiş ve uygulanmıştır.
