Abstract :Islam that accepts justice as a basis of its belief system has used this basic principle in its all institutions of the society. The first generation that received divine revelation obeyed the divine law unconditionally in the guidance of Prophet Muhammad that they were not accustomed this kind of obeying previously. However, while the system of Islamic law was applied in the society very objectively and successfully, in later, although it continued its development in theory, those who aimed the caliphate as a sole objective abused it
