Abstract :Haksız bir şekilde uygulana tutuklama, arama, yakalama gibi koruma tedbirleri nedeniyle tazminata hükmedilmesi Türk ceza hukukunda açık yasal düzenlemeler ile kabul edilmiştir. Bu çalışma ile 466 sayılı Kanun ile 5271 sayılı CMK’nın 141 ila 144. maddeleri ana hatlarıyla değerlendirilmesi amaçlanmıştır.
