Abstract :In diesem Artikel haben wir versucht, die Diskussion über den Überblick des Strafrechtsentwurfes der Regierung in Korea vorzustellen. Im koreanischen Strafgesetz gibt es keinen Tatbestand bei der Bestrafung zu Rechtspflegebehinderung. Darüber liegt der Fokus bei der Bestrafung der Falschaussage des Zeugens. Aber weder im Jahr 2002 noch 2010 ist eine solche Tatbestand nicht akzeptiert. Der Hauptgrund ist, dass die Bevölkerung Sorgen macht, weil durch die Stärkung der Justizbeamten ihre Rechte verletzt werden können.
