Abstract :ÖZ Kefalet sözleşmesinde eşin rızasına ve bu rızanın Türk Borçlar Kanu­nu’nun 603. maddesi gereğince gerçek kişilerin taraf olduğu kişisel güvence verilmesine ilişkin diğer sözleşmelerde de bulunmasına dair Türk Borçlar Ka­nunu’nda yapılan düzenlemenin ne gibi bir ihtiyacı karşılamak amacıyla yapıl­dığı ve bu amacın gerçekleşip gerçekleşmeyeceği, bu düzenlemenin olumsuz sonuçlarının bulunup bulunmadığı çalışmanın konusunu oluşturmaktadır.   Anahtar Kelimeler: Türk Borçlar Kanunu, kefalet sözleşmesi, eşin rıza­sı, kişisel güvence     ABSTRACT Thereasoning of the assessment regarding the amendments in the Turkish Code of Obligations for the existence of consent of spouse in contracts of guaran­tee and the presence of such consent also in contracts in which real persons take part in accordance with the article number 603 of TurkishCode of Obligations, whether the purpose of the amendment concerned has been met and whether there will be negative out comes of this amendment will be the subject of thisstudy.   Keywords: Turkish Code of Obligations, contracts of surety, consent of spouse, guarantee.
