Abstract :Günümüzü n Ceza Hukukunda doktrinler münakaşası âdeta kapanmış gibi gözükmektedir. XI X uncu asn n ikinci yansından itibaren Birinci ^Büyük Harbin sonuna kadar devam eden mektepler mücadelesi, taraflardan hiç birinin diğerini mağlup edememesi suretiyle âdeta bir kompromi üe nihayete ermi gibi gözükmektedir. Pozitivisl teorinin prensibi, ruhu itibariyle gittikçe daha fazla olarak hırpalanıp tenkitlere hedef olduğunu, buna mukabil, bu mektebin teklif eylediği ve biraz da ruh ve prensibinden iştikak eden bazı müesseselerin, tedbirlerin müsbet hukuk sistemleri tarafından benimsenerek mevzuat içine ithal olunduğunu görüyoruz. Bu suretle eklektizm gittikçe zafer bulmaktadır.
